Administrative Law (in particular with respect to construction activities, finance and misdemeanor regulatory violations)
Our firm includes attorneys who have worked in senior management positions in financial and other administrative authorities including state administrative authorities.
Our firm has had some significant successes in proceedings before the Czech Supreme Administrative Court and the Constitutional Court and it successfully represented Milan Štefanec in the case he brought against the actions of the Czech Republic before the European Court of Human Rights in Strasbourg.
In particular, our firm focuses on the following:
- building and zoning legal and administrative procedures starting with the initial planning stages (e.g. filing qualified objections and legal challenges to master planning and zoning decisions, complaints on the land plan in front of a court); our attorneys work with our clients whenever and wherever necessary to resolve a wide range of obstacles, including taking matters before administrative courts (appeal bodies) in order to obtain a successful resolution of development project issues (required approvals, etc.)
- tax issues – especially representation before tax authorities during tax audits, an assessment for additional tax due, etc.
- misdemeanor proceedings and the imposition of other types of administrative sanctions
- issues impacted by or concerned with legislation in the area of municipal law – e.g. in relation to the Czech Municipalities Act, the Act on the Capital City of Prague and Act No. 172/1991 Coll. on the transfer of certain items of property owned by the Czech Republic into the ownership of municipalities
- general client representation matters – i.e. representing clients in relation to other administrative proceedings, including the judicial review of administrative decisions in the area of administrative law or in relation to constitutional law
